Building permit

The planning permission (a mandatory administrative permission) testifies the construction project conformity with laws and regulations and allows the project realization.

A planning permission or façade changes request must be asked by the city council and is obtained within two months.


А - WORKS ON NEW BUILDINGS

Generally, new buildings are subjected to a planning permission, even if they do not have foundation.

Some buildings are not subjected to a planning permission, given their nature or their small importance (except if they are in a protected or listed site) :

• buildings with 2 to 20 m² of gross floor area

• buildings in which height is below 12m and which will not have a floor area creation or a gross floor area ≤ 2 m².

 

B – WORKS ON EXISTING BUILDINGS

The planning permission is requested for :

• the enlargement of a building when a gross floor area superior to 20 m² will be created. For instance when the project is about the creation of additional floor(s) inside the house thus extending the living space;

• when a building does not have the same use anymore (e.g. a shop will become a house) and the works will modify the supporting structure or the building façade;

• The change in the house volume when the works need to drill or enlarge an opening on an exterior wall.

 

C - HAVING THE RIGHT INFORMATION

Before creating your project, I need to check that your wishes are in compliance with regulations.

For every expansion, construction or changes request for your house, I always set up an appointment with the architect of the architectural, town planning and environment council of your city hall, in order to know all the peculiar points in effect in your city. I also ask for information to the departmental and regional office of infrastructure.

 


D - THE CONCEPTION OF YOUR PROJECT STEP BY STEP

• A conception step by step according to your schedule respecting scrupulously your demands and your budget.

• The custom-made and unrestricted conception of your project plans until your complete satisfaction.

• A support and individualized advice on the different materials (ecological, energy-saving, bioclimatic, wood…)

• Computer generated imagery will allow you to picture your project in 3D.

• Finally, graphic and written documents necessary as well as the guarantee of obtaining your planning permission.

 


E - BUILDING SUPERIOR TO 170 M².

The appeal to a state-registered architect to carry out a construction project is compulsory when the net surface area of the entire building is over 170 m².

Thus, my associate architects and I make the request for a ready-to-sign planning permission for a net surface area superior to 170 m² which we will submit for approval.

 


F - PERIOD OF VALIDITY OF THE PLANNING PERMISSION

Since December 20th 2008, the period of validity of the planning permission has increased from two to three years.

This one-year prolongation lasts until December 2010 and applies to valid planning permissions on December 20th 2008.

As the holder of the authorization you can ask the city hall for the prolongation at least two months before its expiration.

 

Planning permissions can be staggered if each interruption lasts less than a year and the works carried out from one year to the next to be considerable and significant.

 


G - ASSEMBLING THE REQUEST FILE

The planning permission is requested by the city hall where the land is or through a form :

• CERFA n°13406*01 (request for a planning permission for a detached house and/or its outbuildings)

• CERFA n°13409*01 (request for a planning permission with or without works or demolitions)
CERFA n°13406*01 must be used for construction projects of a new detached house and its outbuildings (garage, swimming-pool, pool house) or for every works on an existing detached house.

If the project requires demolitions subjected to demolition permission, you can ask via the CERFA n°13406*01 form.

The planning permission form with or without construction and/or demolitions must be used for all the construction or adjustment projects, except the building of a detached house and/or its outbuildings.

 


H - REQUIRED DOCUMENTS

Whatever the planning permission required, it must be completed by the following documents :

• A plan of the land
• A ground plan of the buildings to erect or change
• A longitudinal plan, indicating different levels of the land and of the building
• A plan of the land with the future vegetation (trees with high stalk(s), etc.)
• Instructions describing the land and presenting the project
• Façades and roofing plans (inventory and future project)
• Photographs allowing to locate the land in a close environment and in the landscape
• 3D computer-generated imagery presenting the project concept

The planning permission and the documents must be in 4 copies. An additional copy can be asked especially when the land is located in the perimeter of a protected and historical building which is subjected to the opinion of the architect of “Bâtiments de France”.



I - DEPOSIT OF THE REQUEST FOR A PLANNING PERMISSION

The complete request (planning permission and required documents) must be handed directly to the town planning service of the city hall where the land is, or sent by certified letter with return receipt requested.

 


J - DISPLAY OF THE PLANNING PERMISSION

The result of the planning permission request is displayed in the city hall in the fortnight which follows its deposit and can be seen all the time the request is being discussed.

 


K - TIMELINES FOR APPROVAL

The city hall sends a receipt indicating the time before the answer to the planning permission request.

The calendar is as follows:

• two months to study a request of planning permission for a detached house and/or its outbuildings, 3 months for a planning permission with or without constructions and/or demolitions; if the request is complete

• one month to ask for the missing documents, by certified letter with return receipt requested or by e-mail (if the client accepted this mode of transmission) if the request is incomplete. In this case, the client has 3 months to complete his request.

The council can study the request once it is complete.

When the city hall authorizes by decree the carrying out of the construction project, as described in the planning permission request, it addresses the decree by certified letter with return receipt requested or by e-mail.
